The EB-5 category is for immigrant investors who invest capital in a U.S. commercial enterprise that creates jobs. The standard investment amount is $1.05 million (or $800,000 in a Targeted Employment Area). The EB-5 Reform and Integrity Act of 2022 reformed the program with new requirements.
EB-5 has experienced significant backlogs for China and Vietnam due to high demand from investors in those countries. The priority date is established when the I-526 petition is filed. Regional Center investments and direct investments follow the same priority date system.
Recent years have seen improving movement for most countries as the program processes the backlog from earlier filing surges.
